What is MACT?

Motor Accident Claims Tribunal — Explained Simply

The Motor Accident Claims Tribunal (MACT) is a specialized judicial body established under Section 165 of the Motor Vehicles Act, 1988. It was created specifically to provide fast, accessible justice to road accident victims — without going through the slow and expensive process of a regular civil court.

Every district in India has a MACT. Its sole purpose is to decide compensation claims arising from motor vehicle accidents that result in death, bodily injury, or damage to third-party property. The tribunal has the power to award compensation from the vehicle owner, driver, or insurance company.

If you or your family member has been injured or killed in a road accident — whether it was a car accident, bike accident, truck accident, bus accident, or even a hit-and-run case — you have a legal right to claim compensation through the MACT.

⚖️ Legal Basis — Section 165, Motor Vehicles Act 1988

"Claims for compensation in respect of accidents involving the death of, or bodily injury to, persons arising out of the use of motor vehicles, or damages to any property of a third party so arising, or both, shall be decided by a Motor Accidents Claims Tribunal."

Who Can Claim?

Types of MACT Claims We Handle

💀

Fatal Accident Claim (Death Compensation)

Legal heirs and dependants of a person who died in a road accident can claim compensation for loss of income, funeral expenses, loss of consortium and more.

🦽

Permanent / Partial Disability Claim

Accident victims left with permanent or partial disability are entitled to compensation for future earning loss, medical treatment, pain and suffering.

🏥

Bodily Injury Claim

Medical expenses, loss of income during recovery, pain & suffering — fully claimable under MACT for any bodily injury caused by a motor vehicle accident.

🚗

Third-Party Property Damage

If a vehicle damaged your property — house gate, parked vehicle, shop front — you can file a third-party property damage claim at the MACT.

🏃

Hit and Run Accident Compensation

Key Legal Grounds We Use to Defend MACT Claims

01

Contributory / Sole Negligence of Claimant

If the accident victim was wholly or partly at fault — over-speeding, drunk driving, jumping a signal — we establish contributory negligence to proportionally reduce or eliminate liability.

02

Disputed or Fabricated Income Claims

Claimants often inflate monthly income to increase the multiplier-based compensation. We challenge unsubstantiated income figures with tax records, employment data and cross-examination.

03

Fake or Exaggerated Disability Certificates

We contest dubious disability percentages by engaging independent medical experts, challenging the issuing authority's jurisdiction, and cross-examining the claimant's doctor in court.

04

Policy Exclusions & Coverage Disputes

If the accident occurred outside the policy's coverage — expired policy, excluded driver, non-permitted use of vehicle — we argue the insurer's right to avoid or limit liability under the policy terms.

05

Invalid Driving Licence at Time of Accident

If the driver held no valid licence or was driving a vehicle class not covered by his licence, this significantly impacts the insurance company's liability — a ground we regularly raise as defense.

06

Limitation & Procedural Defects in Claim

Claims filed beyond the prescribed limitation period, or with fundamental procedural defects, can be challenged at the threshold level — saving respondents from lengthy and costly proceedings.

07

Wrong Forum / Jurisdictional Challenge

MACT claims must be filed at the correct tribunal — place of accident, place of claimant's residence, or vehicle registration. Filing at a wrong forum is a valid ground to challenge the proceeding entirely.

08

Multiplier & Compensation Quantum Reduction

Even in cases where liability is established, we argue to reduce the quantum — challenging the multiplier applied, disputing future income projections, and limiting non-pecuniary heads of compensation.

FAQ

Frequently Asked Questions About MACT Claims

Real questions people search for — answered clearly by our MACT advocates.

There is no fixed amount — MACT compensation in India is calculated based on: (1) the victim's age and monthly income, (2) the multiplier assigned by courts for that age group (as per the Sarla Verma v. DTC formula), (3) the nature of injury or death, (4) medical expenses, and (5) dependency of family members. For a 30-year-old earning ₹30,000/month who died in an accident, compensation can exceed ₹40–50 lakh. Contact us for a free case-specific estimate — we can give you a realistic figure within minutes of reviewing your case.

For a death claim: FIR, post-mortem report, death certificate, legal heir certificate, income proof of deceased, insurance policy, RC and DL of the vehicle. For an injury / disability claim: FIR, all medical bills, hospital records, disability certificate, income proof, insurance details. For a hit-and-run case: FIR mentioning untraced vehicle, medical/death documents, application to Claims Enquiry Officer. We help you compile all documents — call us and we'll guide you step by step.

Under the Motor Vehicles Act 1988, the prescribed time limit to file an MACT claim is 6 months from the date of the accident. However, courts regularly condone delay if you can show sufficient cause. That said, filing early is strongly advisable — evidence becomes harder to obtain over time, witnesses become unavailable, and insurance companies use delay against you. If you've already crossed 6 months, call us — we can assess whether delay can be condoned in your case.

If the insurance company is denying or delaying your motor accident claim, you don't have to accept it. You can file a petition before the Motor Accident Claims Tribunal, which will summon the insurance company and compel them to either settle the claim or defend it in court. The tribunal also awards 9% interest per annum on the compensation from the date of filing — so delay by the insurance company actually costs them money. Our MACT lawyers handle insurance dispute cases aggressively. Don't accept a low offer without speaking to us first.

Yes. Even in a hit-and-run case where the vehicle and driver are unidentified, you can claim compensation from the Solatium Fund under Section 161 of the Motor Vehicles Act: ₹2 lakh for death and ₹50,000 for grievous injury. If the vehicle is later traced, you can file a full MACT claim for much higher compensation. Additionally, if the vehicle was uninsured, the MACT can still direct the vehicle owner to pay. Call us — we handle hit-and-run cases regularly and know exactly how to maximise recovery.

The following persons can file an MACT claim: (1) The accident victim themselves for injury claims; (2) Legal heirs and dependants of a person who died — including spouse, children, parents, siblings; (3) Any person authorised by the victim to file on their behalf; (4) A guardian filing on behalf of a minor victim. Note: the claimant does not need to be present in Delhi — MACT claims can be filed before the tribunal at the place of accident, the place of residence of the claimant, or the place of registration of the offending vehicle.

MACT cases are designed to be faster than civil courts, but realistic timelines range from 1 to 3 years depending on the complexity, the tribunal's workload, and whether the insurance company contests the claim. Interim compensation under Section 140 (no-fault liability) can be obtained much faster — sometimes within months — without proving fault. Our MACT lawyers pursue cases with urgency and keep delays to a minimum through proactive case management.

Absolutely. As a respondent — whether you are an insurance company, vehicle owner, driver, transport company or employer — you have a full legal right to contest an MACT claim. You can dispute liability, challenge the claimant's income figures, contest the disability percentage, raise policy exclusions, argue contributory negligence, and challenge the jurisdiction of the tribunal. Our MACT defense lawyers in Delhi handle all these grounds systematically to protect your financial interests.

Yes. If the MACT tribunal has awarded compensation that you believe is legally excessive, based on incorrect facts, or contrary to the established formulas (such as wrong multiplier, inflated income basis, or improper heads of compensation), you can file an appeal before the High Court under Section 173 of the Motor Vehicles Act. From the High Court, a further appeal lies to the Supreme Court. The appeal must typically be filed within 90 days of the MACT award. Our lawyers file and argue such appeals regularly on behalf of insurance companies and vehicle owners.

Don't Wait — Your MACT Claim Has a Time Limit
