There is no fixed amount — MACT compensation in India is calculated based on: (1) the victim's age and monthly income, (2) the multiplier assigned by courts for that age group (as per the Sarla Verma v. Under the Motor Vehicles Act 1988, the prescribed time limit to file an MACT claim is 6 months from the date of the accident. However, courts regularly condone delay if you can show sufficient cause. That said, filing early is strongly advisable — evidence becomes harder to obtain over time, witnesses become unavailable, and insurance companies use delay against you. If you've already crossed 6 months, call us — we can assess whether delay can be condoned in your case.
If the insurance company is denying or delaying your motor accident claim, you don't have to accept it. You can file a petition before the Motor Accident Claims Tribunal, which will summon the insurance company and compel them to either settle the claim or defend it in court. The tribunal also awards 9% interest per annum on the compensation from the date of filing — so delay by the insurance company actually costs them money.
